Policy regarding the collection, use and disclosure of personal information at Immunotec
At Immunotec, we are committed to respecting the privacy of our customers. In the spirit of this commitment, we have developed and implemented a policy regarding the protection of personal information.

“Personal information” refers to any information about a private individual or information that makes it possible to identify said individual. This includes but is not limited to your name, mailing address, telephone numbers, e-mail address, credit card numbers, and other information relating to billing records and accounts. The personal information that we retain about our customers serves primarily to open a file and process orders. Personal information about our Consultants is used for payment of commissions. maintenance of the sales organisation or genealogy and for fiscal requirements.
This personal information will be used:
(a) for statistical purposes;
(b) to respond to your questions about your account and file;
(c) to offer you as our customer information about Immunotec’s products and services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;
(d) to satisfy legislative and regulatory requirements.
(e) to ensure that content from our site is presented in the most effective manner for you and for your computer;
(f) to carry out our obligations arising from any contracts entered into between you and us;
(g) to allow you to participate in interactive features of our service, when you choose to do so; and
(h) to notify you about changes to our service.

Personal information we retain about our customers
At Immunotec, we only retain personal information that you submit when you make a request for automatic shipment of Immunotec products, when you purchase online or when you submit a request to become a Consultant. These forms ask for your consent for us to use your personal information in accordance with the uses set out in our policy regarding the protection of personal information.

It is possible to visit our website without revealing your identity. However, our web server may register the IP address and the domain that you used to access the site, the type and version of web browser and operating system that you use, the number, duration and frequency of visits made to our site, as well as the previous and next websites that you visit. This anonymous information cannot be associated with a particular user. This information is useful to us to monitor the performance of the site for system administration purposes, to make the site more user-friendly, to improve our services and to collect summary information (e.g.: the number of visitors who accessed the site).

You, your Consultant and the sponsoring Consultants of your Consultant have access to your personal information. However, authorised access for Consultants and their sponsors is strictly limited to your name, address, phone number and purchasing history.
We are committed to not disclose your personal information to third parties other than those mentioned in this policy or unless we are required to do so by law or regulation. As well, we will seek your consent should we decide to disclose your personal information to third parties other than those mentioned here.

We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.
We may disclose your personal information to third parties:
- In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
- If Immunotec or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
- If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Immunotec, our Consultants, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
Protecting your personal information
Immunotec is serious about protecting the personal information of our customers and our employees are trained to ensure all personnel information is respected, protected and handled appropriately. Only employees who have a legitimate need to access your personal information to fulfill their duties are authorised to do so. As well, a highly sophisticated computer system ensures the protection of personal information supported by this medium. All files, photocopies of cheques and written requests for automatic shipments of Immunotec products and for distribution are kept in locked filing cabinets in offices with limited access. Finally, all our service providers that require access to our facilities or our computing services are contractually obligated to neither divulge nor use personal information that we retain about our customers.
We limit the length of time we retain personal information about our customers to a period that allows us to supply our products and services, that allows us to respect the timeframes imposed by laws and regulations and that allows us to fulfill legal requirements. At the end of this period, we close each file, and we ensure that all personal information in our possession is destroyed.
We use our best efforts to keep the contents of your personal file up to date. This means that we rely on you to inform us of any changes. You can also help us maintain up-to-date information by periodically verifying the personal information about you in our possession, by updating your personal profile at www.uk.immunotec.com informing our Chief Privacy Officer of any change to the personal information in our possession by sending us at e-mail to infopriv@immunotec.com.
Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. To ensure that your personal information is well protected, we are required to request adequate proof of your identity. This obligation applies to all requests for access, use, retention, correction, modification of consent and communication of any of your personal information in our possession. This proof of identity will be used only for this purpose.

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

Immunotec reserves the right to modify this policy at any time and to issue the new policy amendments through its websites or other means. Any amendments will be made according to the law in effect. Continuing to provide personal information to Immunotec or to use its websites or place orders after amendments to the policy have been posted will be considered an implicit agreement with modifications made to the policy.
